1. Acceptance of Terms
By accessing, browsing, or using the services provided by DataCoreLink Ltd. ("Company", "we", "us", or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), along with our Privacy Policy and all applicable laws and regulations.
These Terms constitute a legally binding agreement between you ("User", "Customer", or "you") and DataCoreLink Ltd. If you do not agree to these Terms, you must immediately discontinue use of our services.
We reserve the right to modify, update, or replace any part of these Terms at any time. Your continued use of our services following any changes constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically.
2. Description of Services
DataCoreLink Ltd. provides enterprise-grade data centre services including but not limited to: Dedicated Server Hosting, Virtual Private Servers (VPS), Colocation Services, Managed Hosting Solutions, Backup and Disaster Recovery, Network Connectivity, DDoS Protection, SSL Certificates, Email Hosting, and Bulk SMS Services.
All services are subject to availability and may be modified or discontinued at our discretion with reasonable notice to affected customers. Service specifications, features, and pricing are as described on our official website and may be updated from time to time.
We maintain a 99.99% uptime Service Level Agreement (SLA) for all core infrastructure services, subject to the terms and conditions outlined in individual service agreements and excluding scheduled maintenance periods.
3. Account Registration & Responsibilities
To access certain services, you must register for an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must be at least 18 years of age or the legal age of majority in your jurisdiction to create an account. By registering, you represent and warrant that you meet this requirement and have the legal capacity to enter into this agreement.
You agree to immediately notify DataCoreLink of any unauthorized use of your account or any other breach of security. We shall not be liable for any loss or damage arising from your failure to protect your account credentials.
Account holders are responsible for ensuring that all users accessing services through their account comply with these Terms. Corporate accounts must designate authorized representatives who will be responsible for managing the account.
4. Account Setup & Email Details
We set up your domain and hosting account after receiving full payment. We verify payment balance before account activation. It is your responsibility to ensure that the email address on file is current and up-to-date.
All hosting cPanel login details are sent to your provided email address. If you provide any false contact information, your account may be terminated without notice.
You must maintain accurate and current contact information in your account at all times. Failure to receive important notifications due to outdated email addresses is solely your responsibility.
5. Payment Terms & Billing
All services are billed according to the pricing plans selected at the time of purchase. When you order our domain and hosting services, you are purchasing a pre-paid service. Prices are quoted in Bangladeshi Taka (BDT) and US Dollars (USD) and are exclusive of applicable taxes unless otherwise stated.
Payment is due upon invoice generation for prepaid services. All payments shall be made in advance using bKash, Rocket, Nagad mobile banking, bank transfer, credit/debit cards, or other approved payment methods. For post-paid services, payment is due within fifteen (15) days of invoice date.
Renewal notifications will be sent via email 1 to 30 days before the renewal date. If you cannot renew the service by the last renewal date, your hosting and domain will be suspended and we will not be liable for any data loss.
We will not set up your account for web hosting plans without any payment. Clients are encouraged to pay via bKash as it is the easiest way to handle payments in Bangladesh at this time.
All fees are non-refundable except as expressly stated in our Refund Policy. Setup fees, domain registration fees, and SSL certificate fees are non-refundable under any circumstances. We reserve the right to modify our pricing with thirty (30) days prior notice.
6. Late Payment Policy
All accounts are billed according to the first activation date. If you do not pay to renew the service within 7 days of the renewal date, your account will be suspended as the last payment date.
If you do not pay to renew the service within 30 days of suspension, your account will be terminated. You will receive several email reminders until deactivation.
A late payment fee of 2% per month may be applied to overdue amounts. We reserve the right to engage collection agencies for outstanding debts.
Suspended accounts may be reactivated upon full payment of outstanding dues plus any applicable late fees. Data retention during suspension period is not guaranteed.
7. Migration & Transfer Services
Our technical team is always ready to help you transfer your site from another hosting provider to us. We always try to transfer all your data from the old host to our host in the best possible way.
Actually hosting a transfer is not our responsibility, it is just a bonus service. DataCoreLink will transfer free of charge for the first time: maximum 1 account for shared hosting, 25 accounts for reseller, 50 accounts for VPS and 100 accounts for a dedicated server.
Additional transfers beyond the free limit will require a fee. Transfer fees vary based on the complexity and size of the data being migrated.
We are not responsible for any data loss or corruption that may occur during the migration process. Clients are advised to maintain their own backups before initiating any transfer.
8. Acceptable Use Policy
You agree to use our services only for lawful purposes and in accordance with these Terms. You shall not use our services to host, transmit, or distribute any content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
Prohibited activities include but are not limited to: Sending unsolicited bulk emails (spam), hosting phishing websites or malware, engaging in cryptocurrency mining without authorization, conducting DDoS attacks, infringing intellectual property rights, and hosting adult content on shared servers.
You shall not attempt to gain unauthorized access to any systems, networks, or data. You shall not interfere with or disrupt the integrity or performance of our services or third-party data contained therein.
We reserve the right to monitor all services for compliance with this Acceptable Use Policy. Violations may result in immediate suspension or termination of services without refund, and we may report violations to appropriate law enforcement authorities.
9. Prohibited Content
The following types of content are strictly prohibited on our servers and will result in immediate account termination without refund:
Hacking-related content, tools, or tutorials; Adult/sexual content or pornography; IRC scripts/bots; Proxy scripts/anonymizers; Pirated software/warez; Hacker sites/archives/programs.
Scripts that run in less than 30 minutes (cron jobs); Email marketing scripts (mass mailing); MLM/investment websites or applications; Phishing websites or fraudulent content.
Any content that violates Bangladesh law or international copyright laws; Malware, viruses, or any malicious software; Illegal gambling or betting websites.
We reserve the right to determine what constitutes prohibited content at our sole discretion. Accounts found hosting prohibited content will be terminated immediately without prior notice or refund.
10. Data Protection & Privacy
We are committed to protecting your personal data in accordance with the Bangladesh Information and Communication Technology Act, 2006, and international data protection standards. Our collection, use, and disclosure of personal information is governed by our Privacy Policy.
You retain all ownership rights to your data stored on our servers. We will not access, review, or disclose your data except as required to provide our services, comply with legal obligations, or enforce our Terms.
We implement industry-standard security measures including encryption, firewalls, and access controls to protect your data. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.
In the event of a data breach affecting your personal information, we will notify you within seventy-two (72) hours of becoming aware of such breach, in accordance with applicable laws.
11. Backup & Data Loss
If you use any service of DataCoreLink, you do so at your own risk. Our backup service is performed every Friday or Sunday and is provided to you as a courtesy.
DataCoreLink is not responsible for files and data in your account. You agree to take full responsibility for your files and data transfer and to maintain proper backups of files and data stored on our servers.
Backups will not be provided for accounts that have been suspended or terminated for any reason. We strongly recommend maintaining your own independent backup solution.
While we implement robust backup systems, we cannot guarantee 100% data recovery in all circumstances. Hardware failures, natural disasters, or other unforeseen events may result in data loss.
12. Service Level Agreement (SLA)
DataCoreLink guarantees 99.99% network uptime for all dedicated server and colocation services. This uptime guarantee excludes scheduled maintenance windows, which will be announced at least forty-eight (48) hours in advance.
In the event of downtime exceeding our SLA commitment, eligible customers may request service credits. Credits are calculated as a percentage of the monthly service fee proportional to the downtime experienced.
SLA credits must be requested within thirty (30) days of the incident. Credits will be applied to future invoices and are not redeemable for cash. Maximum credit per month shall not exceed 100% of the monthly service fee.
The SLA does not apply to: scheduled maintenance, customer-caused issues, force majeure events, third-party service failures, or services suspended due to non-payment or Terms violations.
13. Termination & Cancellation
You may cancel your services at any time by submitting a cancellation request through your client portal or by contacting our support team. Cancellation will be effective at the end of the current billing period.
We may suspend or terminate your services immediately, without prior notice, if: you breach these Terms, you fail to pay for services, your use poses a security risk, or we are required to do so by law.
Upon termination, your right to use our services will cease immediately. We will retain your data for thirty (30) days following termination, after which it will be permanently deleted unless legally required to retain it.
You are responsible for exporting your data before termination. We are not obligated to provide any data after the thirty (30) day retention period has expired.
14. Refund Policy
DataCoreLink reserves the right to cancel, suspend, and restrict access to accounts at any time with or without notice.
If you are dissatisfied with the services received from DataCoreLink within the first 7-10 business days of receiving the service (Shared Hosting, Cloud Hosting, and WordPress Hosting only), you may request a full refund.
You must provide a detailed reason why you are canceling. If we cannot resolve the issue in a short time, we will provide you with a full refund within 30 days.
Refunds will not be given if clients violate the terms and conditions and are suspended, even if asked to cancel and agree to continue using the services. A refund cannot be requested a second time.
Domain registrations, SSL certificates, dedicated servers, VPS, and reseller hosting plans are non-refundable under any circumstances.
15. Limitation of Liability
To the maximum extent permitted by applicable law, DataCoreLink Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.
Our total liability for any claims arising from or related to these Terms or our services shall not exceed the total amount paid by you to DataCoreLink during the twelve (12) months preceding the claim.
We do not warrant that our services will be uninterrupted, error-free, or completely secure. Services are provided "as is" and "as available" without warranties of any kind, either express or implied.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, the above limitations shall apply to the fullest extent permitted by applicable law.
16. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the People's Republic of Bangladesh, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or our services shall first be attempted to be resolved through good faith negotiations between the parties for a period of thirty (30) days.
If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in Dhaka, Bangladesh, in accordance with the Arbitration Act, 2001. The arbitration shall be conducted in English or Bengali as agreed by the parties.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information.
17. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be notified through email to the address associated with your account and/or by posting a prominent notice on our website.
Changes will become effective thirty (30) days after notification unless a longer period is required by law. Your continued use of our services after changes become effective constitutes your acceptance of the revised Terms.
If you do not agree to the modified Terms, you must discontinue use of our services before the changes become effective. Any use of services after the effective date will be subject to the new Terms.
We encourage you to periodically review these Terms to stay informed of updates. The "Last Updated" date at the top of these Terms indicates when they were last revised.
